What FMCSA's driver qualification regulations actually require — not as one blended rule, but as the several distinct requirements a qualification file bundles together: a previous-employer safety investigation, a motor vehicle record pulled at hiring, an annual review of that record, medical certification, and a road test or an accepted equivalent. Each of these is its own section of 49 CFR Part 391 with its own conditions.
How This Area Fits Your Operation
49 CFR 391.51 lists what a driver qualification file must contain, but the rules for each item live in their own sections. Before hiring, a carrier must investigate the driver's safety performance history with DOT-regulated previous employers going back 3 years (§391.23), with the driver's written consent — a driver who won't consent cannot be put behind the wheel. Separately, within 30 days of employment, the carrier must pull the driver's motor vehicle record from every state where they held a license in the preceding 3 years (also §391.23(a)). That pre-hire pull is distinct from the annual review under §391.25, which recurs at least once every 12 months for as long as the driver is employed. Medical qualification (§391.41–391.45) requires an exam from a provider on FMCSA's National Registry of Certified Medical Examiners, with a certificate generally valid up to 24 months. And before operating, the driver needs a road test (§391.31) — or, in its place, an accepted equivalent such as a valid CDL earned through a state road test, or a road test certificate from a previous employer within the last 3 years (§391.33).

- Skipping the previous-employer safety performance investigation because a road test and MVR were already completed
- Letting the annual MVR review lapse because no single document reminds a carrier it's due
- Discarding a driver's qualification file immediately after the driver leaves, rather than retaining it for the required additional three years
- Treating a road test as always required, without checking whether an accepted equivalent (a qualifying CDL, or a recent prior road test certificate) applies
When To Confirm The Requirement
The exact current subsection lettering within 49 CFR 391.23 (the previous-employer investigation and MVR-pull provisions) is worth confirming directly at eCFR before relying on a specific paragraph citation — the substance of the requirement is well-established, but section numbering can shift. Medical exemptions under Part 381, and any farm-vehicle-driver exception under 391.2, are narrow and fact-specific; confirm applicability to a specific driver directly rather than assuming either applies.
